TERMS OF SERVICE

Digital Marketing Accelerator

1. ACCEPTANCE OF TERMS

By purchasing, accessing, or using any services, products, programs, courses, templates, tools, or content provided by Digital Marketing Accelerator ("Company", "we", "our", "us"), you ("Client", "you", "your") agree to be bound by these Terms of Service.

If you do not agree to these Terms, you must not purchase, access, or use our products, services, or materials.

2. SERVICES AND PRODUCTS COVERED

These Terms apply to all Digital Marketing Accelerator offerings, including but not limited to:

• Facebook Lead Generation Campaign Setup and Management

• Digital Marketing Consulting Services

• Funnel Design and Optimization

• Content Creation and Copywriting Services

• SEO Strategy and Implementation

• Email Marketing and Automation Setup

• Social Media Marketing Services

• Landing Page Design and Development

• Marketing Automation Workflows

• Digital Products (courses, templates, toolkits, guides)

• Training Programs and Educational Content

• Membership Programs and Subscriptions

• Coaching and Consulting Sessions

• Done-For-You Services

• Software and Tool Recommendations

3. PRICING AND PAYMENT TERMS

Pricing:

• Service pricing varies by package and is clearly stated at time of purchase

• Digital products are sold at the price displayed on the sales page

• Subscription services are billed according to the selected billing cycle (monthly, quarterly, or annually)

• Custom services are quoted individually

Payment Terms:

• Payment is due in full prior to service delivery or product access unless otherwise agreed in writing

• Subscription payments are processed automatically on the renewal date

• All prices are in USD unless otherwise specified

• We accept major credit cards, PayPal, and other payment methods as displayed

• Failed payments may result in service suspension or access revocation

4. REFUND POLICY

Service-Based Work:

• No refunds are provided for service-based work once delivered, except in cases where we fail to deliver the agreed-upon service due to our error

• Refund requests must be submitted within 7 days of service delivery with detailed documentation of service failure

Digital Products:

• Digital products (courses, templates, guides, toolkits) are generally non-refundable due to their nature

• If a technical issue prevents access to your purchase, contact support within 14 days for resolution

• Refunds are not provided for change of mind, lack of results, or failure to use the product

Subscriptions:

• Monthly subscriptions can be cancelled at any time; no refunds for partial months

• Annual subscriptions may be eligible for pro-rated refunds within 30 days of purchase

• No refunds after 30 days of annual subscription purchase

Results Disclaimer:

• We do not guarantee specific results, revenue, leads, conversions, or business outcomes

• Success depends on many factors outside our control including your effort, market conditions, implementation, and business model

• Testimonials and case studies represent specific client results and are not typical or guaranteed

5. CLIENT RESPONSIBILITIES

To ensure successful service delivery, you agree to:

• Provide timely access to necessary accounts, platforms, and assets (Facebook Business Manager, website, etc.)

• Respond to communications within 48 business hours

• Provide accurate information, content, images, and materials as requested

• Maintain valid payment information on file

• Review and approve deliverables within specified timeframes

• Follow implementation instructions and recommendations

• Comply with all platform policies (Facebook, Google, etc.)

• Maintain ownership and responsibility for all advertising spend on third-party platforms

6. INTELLECTUAL PROPERTY RIGHTS

Our Property:

• All content, frameworks, templates, strategies, videos, courses, documents, trainings, and proprietary systems are the exclusive intellectual property of Digital Marketing Accelerator

• You are granted a limited, non-transferable, non-exclusive license for internal business use only

• You may not copy, share, sell, distribute, reproduce, or create derivative works from our materials

• You may not repurpose our materials for your own programs, products, or training

• You may not rebrand, white-label, or resell our content without written permission

Your Property:

• You retain ownership of all materials you provide to us (logos, content, images, etc.)

• You grant us a license to use your materials solely for delivering services to you

• We may request permission to use your results as testimonials or case studies

7. CONFIDENTIALITY AND NON-DISCLOSURE

You agree to maintain confidentiality of:

• Proprietary systems, frameworks, and methodologies shared during service delivery

• Non-public business strategies and tactics

• Training materials and program content

• Any information marked as confidential or proprietary

You may not disclose, replicate, share, or distribute confidential information to third parties or competitors.

8. COMMUNICATION AND SUPPORT

Primary Communication Channels:

• Email: [email protected]

• Facebook Messenger (for active clients)

• Client portal or project management system (if applicable)

Support Hours:

• Monday - Friday, 9 AM - 5 PM EST

• Response time: Within 48 business hours for standard inquiries

• Emergency support availability varies by service package

9. SERVICE DELIVERY TIMELINES

• Project timelines are specified in individual service agreements or proposals

• Timelines begin after all required access, materials, and information are received

• Delays caused by client unavailability, late feedback, or missing materials extend delivery dates accordingly

• Rush delivery may be available for additional fees

10. ACCOUNT ACCESS AND SECURITY

For services requiring platform access:

• You maintain ownership of all accounts (Facebook, Google, website, etc.)

• You grant us Admin or Manager-level access as needed to perform services

• We do not access billing information or payment methods unless explicitly authorized

• You may revoke access at any time, which may affect our ability to deliver services

• We follow industry-standard security practices to protect your account information

11. THIRD-PARTY PLATFORMS AND ADVERTISING

Facebook/Meta Advertising:

• You are responsible for all ad spend paid directly to Facebook/Meta

• You maintain ownership of your Facebook Business Manager and Ad Accounts

• You must comply with Facebook's Terms of Service, Advertising Policies, and Community Standards

• Account suspensions, ad rejections, or policy violations are outside our control

Other Platforms:

• Similar terms apply for Google Ads, LinkedIn, YouTube, and other advertising platforms

• You are responsible for compliance with each platform's policies and terms

12. LIABILITY AND WARRANTIES

Disclaimer of Warranties:

• Services and products are provided "as is" without warranties of any kind

• We do not guarantee specific results, revenue, leads, sales, or business outcomes

• We are not liable for decisions you make based on our advice, strategies, or recommendations

Limitation of Liability:

• Our total liability is limited to the amount you paid for the specific service or product

• We are not liable for indirect, incidental, consequential, or punitive damages

• We are not responsible for lost profits, revenue, data, or business opportunities

• You assume full responsibility for implementation and results

13. INDEMNIFICATION

You agree to indemnify and hold Digital Marketing Accelerator harmless from any claims, damages, losses, or expenses arising from:

• Your use of our services or products

• Your violation of platform policies or terms

• Your advertising content or business practices

• Your breach of these Terms

• Third-party claims related to your business operations

14. TERMINATION

We reserve the right to terminate services or revoke access if you:

• Violate these Terms of Service

• Fail to fulfill payment obligations

• Engage in abusive, threatening, or inappropriate behavior

• Share or distribute confidential or proprietary information

• Use our products or services for illegal purposes

• Cause harm to our reputation or business

Termination may result in loss of access without refund. Outstanding balances remain due upon termination.

15. MODIFICATIONS TO TERMS

We may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email.

16. GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law:

• These Terms are governed by the laws of the United States

• Any disputes shall be resolved in accordance with applicable state and federal law

Dispute Resolution:

• Before filing any legal action, parties agree to attempt good-faith negotiation

• If negotiation fails, disputes may be resolved through binding arbitration

• Each party is responsible for their own legal fees and costs

17. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Digital Marketing Accelerator and supersede all prior communications, agreements, or understandings, whether oral or written.

Individual service agreements or proposals may contain additional specific terms that supplement these Terms.

18. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
